Electric Bike Test Ride Waiver and Release of Liability

I acknowledge that by signing this document I am releasing Chattanooga Electric Bike Co. from liability. This application is a contract with legal consequences. I have been advised to read it carefully before signing. In consideration of the acceptance of my application for entry into this test ride club, I hereby freely agree to and make the following agreements:

Before doing so, please be aware of the following:

• An ebike/moped/scooter is capable of going much faster than you may be used to. Please start your ride with the pedal assist mode, or scooter power off or on low. Get used the ebike/moped/scooter before you use the faster speed modes.
• An ebike/moped/scooter a much heavier bike, or scooter (due the battery and motor) so it will handle differently. Please be stable and gentle ride.
• Please make sure you are physically capable of riding ebike/moped/scooter.
• I agree that I am sober and of sound mind and that I'm in possession of all my faculties.
• I agree to wear a protective bicycle helmet during the test ride.

In consideration of permission to TEST RIDE ebike/moped/scooter, I agree to the following:

• All types of biking, scootering, and physical activity involve risks, I understand and assume these risks (serious injury or death) and freely accept the responsibility associated with biking.
• It is my responsibility to determine the safety of the areas where I ride.
• I release and agree not to sue Chattanooga Electric Bike Co. , its agents, members, and employees (collectively the "Releasees") from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees otherwise, including negligent rescue operations, and I further agree that if, despite this Waiver and Release of Liability, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify and hold harmless each of the Releasees from litigation expenses, loss, liability, damage, or cost which may result as of the result of such claim.

I certify that a representative of Chattanooga Electric Bike Co. has explained to me and I understand how to:

1. Operate the gears and brakes.
2. Operate the pedal assist controls.
3. Operate the throttle scooter assist controls.

I AM OF 18 YEARS OF AGE OR OLDER, HAVE READ AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT, HAVE SIGNED IT VOLUNTARILY AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I AGREE THAT IF ANY PORTION THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT.  THIS AGREEMENT IS GOVERNED BY THE APPLICABLE LAWS OF THIS STATE.
